Buying off-plan in Cyprus

Off-plan gets you a better price and first choice of unit. Here is how to take that opportunity without carrying the developer's risk.

Why buyers go off-plan

Prices at launch are typically 8–15% below the same unit on completion, payment is spread across construction rather than due at once, and the best-positioned homes in a small development go first.

In a nine-unit building, the difference between the best and worst residence is substantial and permanent. Early buyers get to choose.

How stage payments should be structured

Payments should follow certified construction progress, not the calendar. A typical schedule looks like this.

  • 20–30% on signing the contract of sale
  • 10–20% on completion of the structural frame
  • 10–20% on completion of walls, roof and envelope
  • 10–20% on installation of mechanical and electrical services
  • 10% on completion of internal finishes
  • Balance on delivery and handover

The five protections to insist on

Each of these is normal in a well-run Cyprus development. If a developer resists any of them, treat that as information.

  • Contract lodged at the Land Registry within six months of signing
  • A fixed delivery date with a defined penalty for late delivery
  • Confirmation that any bank mortgage over the land will be released on your unit at transfer
  • Payments certified by an independent engineer before release
  • A written defect liability period after handover, plus statutory structural liability

Questions worth asking before you reserve

Ask to see the building permit, not just the planning permit. Ask which contractor is building, and whether they have completed comparable work. Ask what the quoted square metres include. Ask what happens to your payments if construction stops.

A developer with good answers will have them ready in writing.

What happens if the developer becomes insolvent?
If your contract of sale was lodged with the Land Registry, your right of specific performance ranks ahead of later creditors and the unit cannot be transferred to anyone else, which is why lodging the contract quickly matters so much.
Can I sell an off-plan contract before completion?
Assignment is possible but depends on the terms of the contract and the developer's consent, and may trigger stamp duty and tax consequences. Check the assignment clause before signing.
